Appeals Justices Council decides not to recuse the corruption prosecutors in the Novartis case

The Appeals Justices Council on Tuesday threw out a petition filed by public prosecutor Eleni Raikou asking for the recusal of the corruption prosecutors investigating alleged payments to doctors by Novartis.

The motion had been filed by Raikou and her husband, the doctor Lazaros Karnezis, whose name was included in a list of thousands of physicians that had received payments from the pharmaceutical company, on the grounds that the confidentiality of the investigation had been breached.

The council adopted the recommendations of public prosecutor Rania Stathea, who asked them to reject the petition and noted that there was no evidence for the claim that Karnezis’ name had been leaked by the corruption prosecutors.

The appeals justices, in a new panel, must convene in the coming days to decide whether the prosecutors’ investigation into Karnezis should temporarily stop until the hearing in March of mistrial suit filed by Raikou and her husband, who are seeking 300,000 euros in compensation.
